March 25, 2019 – In February, Circuit Judge Laura Johnson made a ruling in a separate patient-brokering case that could change the outcome of future prosecutions. In part of her ruling, she said prosecutors must prove that those charged with patient brokering knew what they were doing was illegal. Before the ruling, prosecutors only had to prove that those charged were paying in part for the referral of patients. This was the first patient-brokering case to go to trial after the State Attorney’s Office created the Sober Home Task Force in 2016. A Palm Beach Post investigation revealed details about those in the treatment industry conducting unnecessary and expensive drug testing on patients.
