That’s the situation facing one small community in Pike County. … While it’s sad that we have so many of these facilities, some of which have been or are being looked at for fraudulent billing, the facilities are still needed.
I listen to Howard Stern; he’s a great interviewer and oftentimes when not acting like a 12-year-old he’s funny. He has touted that porn websites are now being banned in some sates and in other states you apparently need to provide personal information. Being addicted to pornography is another type of addiction but states are censuring the access. Is that legal? Is that a violation of the ADA?
In January 2025, Kentucky will legalize the use of marijuana for medical purposes. In our region, according to my crack research, there are 11 counties. In those 11 counties, the state will allow only four dispensaries.
The issue Coal Run is facing is whether their residents want a medical marijuana dispensary in their community. According to Mayor Scott, that question will be on the ballot next election. The likelihood of Coal Run getting one is slim. But they clearly will be getting a sober living facility.
If the election results say that the Coal Run residents don’t want a dispensary in their neighborhood, and if a user is addicted but access to marijuana is banned, is that discrimination? Can the ADA go after the city for discrimination against people with a marijuana addiction? That’s a question for the NORML lawyers.
