Oxycontin maker pushes judge to toss out AG’s lawsuit over opioid epidemic

Sept. 28, 2018 – Lawmakers curbed on how much ephedrine a customer can buy in bulk and required signatures and identification in an effort to battle meth addiction, but lawsuits failed – with good reason, Coleman argued at a hearing Friday. “The proximate causation argument is the same,” Coleman said. “Basically it’s a misuse of the drug.”

But Davis was skeptical. She noted ephedrine makers weren’t accused of deceit about their product or marketing it to meth addicts. Purdue is. “You’re talking about people going out and buying a product and using it in an illegal way,” she said.  Coleman wants Judge Kristi Davis to throw the lawsuit out. He compared  it to methamphetamine, an illegal drug made by addicts using easily and legally purchased ingredients including the stimulant ephedrine.
